he/she or they, are taken as interchangeable and therefore are referring to the

We reserve the right to request

agree to be bound to and follow these linking Terms and Conditions.

Cancellation & Refunds
1. MGH Consulting offers three tiers of
subscriptions for it’s B2C (business to customer) clientele:
a.
One Monthly (otherwise known as
Monthly), paid at a rate of 31 days per period
b.
Three Monthly (otherwise known
as Quarterly), paid at a rate of 92 days per period
c.
Twelve Monthly (otherwise known
as Annual or Annually), paid at a rate of 365 days per period
2.
Each subscription model comes
with an auto-renew payment scheme
3.
All subscription models come
with a minimum non-refundable fee, at the rate of the ‘One Monthly’ subscription fee
4.
Should a customer wish to
cancel their subscription they should contact MGH Consulting via the contact form on https://mghconsulting.io/
5.
In the event a ‘Monthly’
customer wishes to cancel their subscription, they will not be due or entitled to a refund
for the month they have paid for.
a.
The cancellation ensures they
will not be charged any further payments
6.
In the event a ‘Three Monthly’
customer wishes to cancel their subscription:
a.
The first month of their Three
Monthly period is non-refundable (as per clause 3)
b.
The remaining balance of the
subscription shall be calculated on a pro-rata daily basis as per the ‘Three
Monthly’ subscription rate, minus the first month
c.
To elaborate clause 6b further:
i.
Should a customer be 40 days
into their Three Monthly subscription when they notify MGH Consulting of their wish to
cancel, 31 days of which are automatically non-refundable; A further 9 days are
non-refundable; Making 52 days refundable at the daily rate of the Three
Monthly subscription calculated as follows:
ii.
$80.98 x 4 = $323.92 per year
(rounded up to two decimal points)
$323.92 / 365 = $0.89 per day (rounded up to two decimal points)
$0.89 * 52 = $46.28 refundable (rounded up to two decimal points)
7.
In the event a ‘Twelve Monthly’
customer wishes to cancel their subscription:
a.
The first month of their Twelve
Monthly period is non-refundable (as per clause 3)
b.
The remaining balance of the
subscription shall be calculated on a pro-rata daily basis as per the ‘Twelve
Monthly’ subscription rate, minus the first month
c.
To elaborate clause 7b further:
i.
Should a customer be 100 days
into their Twelve Monthly subscription when they notify MGH Consulting of their wish to
cancel, 31 days of which are automatically non-refundable; A further 69 days
are non-refundable; Making 265 days refundable at the daily rate of the Twelve
Monthly subscription calculated as follows:
ii.
$305.90 per year
$305.90 / 365 = $0.84 per day (rounded up to two decimal points)
$0.84 * 265 = $222.60 refundable (rounded up to two decimal points)
8.
The date of cancellation shall
always be calculated from the date the request is sent by the subscriber, not
the date MGH Consulting action upon the request
a.
The subscriber will receive an
auto-response via email, so they have proof of date in writing
9.
In the event a Cancellation
Request is not processed before the end of the subscribers current payment term,
and a further payment is taken for a new payment term, the subscriber will be
refunded in full the value of the new payment term, prior to any further
calculations of entitled refund (if applicable as per clauses 3 & 5)
10.
From Year Two onwards of any
Annual Subscription the subscriber will have up to 31 days when the
subscription auto-renews to send their cancellation request for a full refund
of Year Two (or subsequent years)
a.
For example, If a subscriber
enters Year Three but sends a cancellation request within 31 days of Year Three
starting, they are entitled to a full refund of the Year Three Subscription,
but not for the previous subscription periods (in this example, Year’s One and
Two)
b.
After 32 days or more into Year
Two or onwards of any annual subscription, clauses 3 & 7 come into effect
11.
Should any subscriber have
further questions regarding their Cancellation and Refund rights please don’t
hesitate to contact MGH Consulting via the contact form on https://mghconsulting.io/ and we will endeavour
to respond within 10 days.
Service Level Agreements (SLAs)
1. MGH Consulting will endeavour to respond
to the following:
a.
B2B (Business to Business)
Enquiries within 3 days
b.
Complaints within 7 days
c.
Cancellation / Refund Requests
within 10 days
d.
General Enquiries within 14
days
2. MGH Consulting are under no legal
obligation to adhere to the above SLAs set out in clause 1
3. MGH Consulting can amend the SLAs stated
in clause 1 at any time as per business needs
4.
Should MGH Consulting not respond within
SLA periods offered in clause 1, the customer will not be entitled to
compensation of any kind
a. MGH Consulting may offer a Gesture of
Goodwill, but are under no obligation to do so
5.
All enquiries, requests or
complaints received shall be considered on an individual basis, and do not
necessarily reflect or guarantee the same response from MGH Consulting even if from the
same sender
a. For example: If Subscriber A files a complaint they may receive a Gesture of Goodwill from MGH Consulting, If Subscriber A files another complaint they may not receive a Gesture of Goodwill
Disclaimer
1. To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:
a.
Limit or exclude our or your liability for death
or personal injury;
b.
Limit or exclude our or your liability for fraud
or fraudulent misrepresentation;
c.
Limit any of our or your liabilities in any way
that is not permitted under applicable law; or
d.
Exclude any of our or your liabilities that may
not be excluded under applicable law.
2.
The limitations and prohibitions of liability
set in this Section and elsewhere in this disclaimer:
a.
Regarding subject to the preceding paragraph;
b.
Govern all liabilities arising under the
disclaimer, including liabilities arising in contract, in tort and for breach
of statutory duty.

We will not be liable for any loss or damage of
